User-Generated Content (UGC) Policy

1. Purpose

We love seeing how our community uses and enjoys our vehicles. This User-Generated Content (“UGC”) Policy explains how Bombardier Recreational Products Inc. and its affiliates and subsidiaries (collectively, “BRP”) may request, collect, and reuse content shared by users on social media platforms.

By granting permission under this Policy, you allow us to repost your content on our official channels and marketing materials.

 

2. What Is User-Generated Content?

User-Generated Content includes photos, videos, captions, comments, stories, reels, and other content created and publicly shared by users on social media platforms (e.g., Instagram, Facebook, TikTok, YouTube, X/Threads) that feature or reference BRP, our vehicles, or our trademarks.

 

3. How We Request Permission

When we would like to reuse your content, we may:

  • Comment on your post;
  • Send you a direct message; and/or
  • Ask you to reply using a specific hashtag (e.g., #YesBRP).

By replying affirmatively (e.g., “Yes,” using the requested hashtag, or otherwise confirming consent), you agree to this UGC Policy.

 

4. License You Grant to Us

You retain ownership of your content.

By granting permission, you give BRP a non-exclusive, royalty-free, worldwide, perpetual, and irrevocable license to:

  • Repost, share, publish, display, and distribute your content;
  • Use your content for marketing, advertising, promotional, and commercial purposes; and/or
  • Edit, crop, resize, or adapt the content for format or branding purposes.

 

This may include use on:

  • Our social media accounts
  • Our websites and apps
  • Digital ads, emails, and newsletters
  • Online and offline marketing materials
  • Physical marketing materials

 

5. Credit

Where reasonably possible, we will credit you by tagging your social media handle or name. However, credit is not guaranteed in all formats or media.

 

6. Your Representations and Responsibilities

By granting permission, you confirm that:

  • You are the original creator of the content or have all necessary rights to grant this license;
  • You have reached the age of majority where you live or you have obtained the valid consent from a parent or legal guardian;
  • You have all necessary rights to give us a license on the music used in any video;
  • Any identifiable individuals in the content have consented to being featured;
  • The content does not infringe any third-party rights (including copyright, trademark, patents, privacy, or publicity rights);
  • The content complies with the terms of the social media platform on which it was posted; and
  • The content respect all applicable laws and regulations.

 

7. Indemnification

If you do not comply with the representations and warranties above, you will indemnify and hold BRP harmless from and against all third-party claims related to the content.

 

8. Content We Will Not Use

We reserve the right not to use content that includes, for example:

  • Dangerous, illegal, or reckless vehicle use;
  • Unsafe driving or misuse of vehicles;
  • Hate speech, harassment, or discriminatory content;
  • Sexually explicit or violent material; and/or
  • Content that could harm people, property, or our brand reputation.

Granting permission does not guarantee that your content will be reposted.

 

9. Removal Requests

If you change your mind, you may request removal of your content from our channels by contacting us at privacyofficer@brp.com.

Please note that:

  • Removal may not be immediate; and/or
  • Content already used in campaigns or printed materials may not be fully retractable.

 

10. No Compensation

You acknowledge that you will not receive payment or other compensation for the use of your content, unless otherwise agreed in writing.

 

11. Privacy

Any personal information we collect in connection with UGC will be handled in accordance with our Privacy Policy: https://www.brp.com/en/privacy-policy.html.

12. Third-Party Platform

The content may be collected, managed, or processed through third-party platforms. Your use of the third-party platform(s) is subject to the terms and conditions (including privacy terms and conditions) of such platform(s). BRP disclaims all liability should you fail to comply with the third-party platform(s) terms and conditions.

 

13. Governing Law

This Policy is governed by the laws of the province of Québec, without regard to conflict of law principles.

 

14. Language

This Policy and all related documents are also available in French. La présente Politique et tous les documents connexes sont aussi disponibles en français. In the event of any discrepancy or inconsistency between the English language version and any other version of this Policy in another language, the English version shall prevail.
